A UCF student was arrested at a UF fraternity house Oct. 5 on suspicion of sexual battery against his ex-girlfriend.
Matthew Hernandez, 18, was arrested after reportedly sexually battering the victim in a house party at the Theta Chi Fraternity house Oct. 5.
According to a report from the UF Police Department, Hernandez gave the victim several alcoholic beverages. After being separated, he reportedly texted her repeatedly to find her location upstairs.
The victim was extremely intoxicated but remembered being in a small bathroom where she was “slipping in and out of consciousness,” according to the arrest report.
Hernandez reportedly began raping her. The next thing the victim said she remembered was seeing her blood on the bathroom floor, according to the arrest report.
According to the report, the victim was too intoxicated to consent to having sexual intercourse with Hernandez.
Hernandez told police he went into the bathroom with her in the first place to make sure she was OK, and that the two were both being touchy towards one another from the start of the night.
After interviewing Hernandez, UFPD charged him with sexual battery and arrested him Oct. 5.
