UPDATE:Max Bornstein was found innocent of all charges, and his official record has been sealed. In legal view, this episode never occurred.
A UF student was arrested early Monday in connection with a knife-pulling at Jennings Hall.
UF freshman Max Bornstein, 18, was arrested by the University Police Department around 1 a.m. Monday on charges of aggravated assault and civil battery, said Capt. Jeff Holcomb, UPD spokesman.
Police received a call early Monday from UF freshman Gary Cantor, 18, who told police he was assaulted by Bornstein, Holcomb said.
Bornstein lives above Cantor in Jennings Hall, Holcomb said.
He said Cantor went upstairs to ask Bornstein to quiet down.
Cantor told police that he and Bornstein began to argue and that Bornstein shoved him against a wall, brandishing a knife, Holcomb said.
After the incident, Cantor said he returned to his room and called police.
Upon arrival, police interviewed witnesses, including Bornstein's roommate, and arrested Bornstein in connection with the knife threat, Holcomb said.
Under state law, aggravated assault is charged when a victim feels threatened, regardless of whether there was intent behind the act, he said.
Bornstein was booked into Alachua County Jail at about 4 a.m., said Tiffany Bratcher, a criminal justice technician with the Alachua County Sheriff's Office. He was released at about 2 p.m. the same day without bond on judge's orders, she said.
Bornstein has no criminal record in Gainesville, wrote Angela Trent, an ASO shift supervisor, in an e-mail.
Holcomb said the size of the knife wasn't listed in UPD's report of the incident.
"There are swords, and there are pocket knives," Holcomb said. "This falls somewhere in between."
